Validity
The general terms and conditions of dropz AG are an integral part of all offers, orders and order confirmations. -
Offer
The offer of dropz AG (hereinafter the "Company") includes, among other things, an online store for the products of the dropz product line and any other products. The online store www.dropz.com only supplies customers in Switzerland. -
dropz AG (Online Shop)
All deliveries by dropz AG are made exclusively on the basis of the following terms and conditions.
3.1 Prices
[1] Prices are shown in Swiss francs (CHF) and include the statutory value added tax. The prices stated on the website at the time the order is received shall apply.
3.2 Postage and shipping costs
[2] Free shipping for private customers from CHF 30.00. Shipping costs small quantities: CHF 4.90, small parcel shipping costs: CHF 8.90. Delivery time: 1-3 working days. Partial deliveries possible.
3.3 Payment method
[3] Payment with the payment options and conditions offered in the store.
For private customers with the payment method "purchase on account". With the single invoice, you can simply pay for your online purchase by invoice. If you choose not to pay within the specified time frame, you will receive a monthly invoice with an order overview in the following month. In the event of non-payment of an invoice, the customer will be charged an additional fee of CHF 50.00.
[3.1] Purchase on account with installment facility (POWERPAY)
As an external payment service provider, MF Group / POWERPAY offers the payment method "purchase on account". With the single invoice, you can simply pay for your online purchase by invoice. If you choose not to pay within the specified time frame, you will receive a monthly invoice with an order overview in the following month.
When the purchase contract is concluded, POWERPAY takes over the invoice claim and processes the corresponding payment modalities. When purchasing on account, you accept, in addition to our GTC, the www.powerpay.ch/de/agb of POWERPAY. (powerpay.ch/en/agb)
You will receive the invoice free of charge by email. With purchase on account you accept the www.powerpay.ch/de/agb from POWERPAY (powerpay.ch/en/agb), provided you have a valid e-mail address.
[4] The customer agrees that dropz AG may grant third parties involved in the credit assessment of the customer and in the collection of the purchase price (in particular the credit agency CRIF AG, Zurich, or a company affiliated with it) access at any time to the customer's personal data arising from the business relationship, including all payment history from the order process. The customer is entitled to revoke the above consent in writing at any time.
3.4 Delivery
[5] The delivery is usually dispatched within 1 to 10 working days after receipt of the order. In the event of delayed shipment, the customer has neither a right to compensation nor a right of withdrawal. If dispatch takes an unusually long time, the customer must give notice of this at least once before he can withdraw from the contract.
3.5 Complaints
[6] The delivery of dropz cannot be exchanged or returned, except in the case of damaged goods, as they are foodstuffs. For dropz accessories, the delivery can be returned or exchanged within 30 days of receipt and non-use. The transportation costs for the exchange of accessories must be borne by the customer. In the event of a return, the customer will be issued a voucher for the value of the product.
3.6 Improvements and changes
[7] dropz AG reserves the right to make product changes that serve to improve quality from the customer's point of view, even without prior notice.
- General provisions
4.1 Quality
[8] dropz AG provides its services carefully and in accordance with generally accepted (internal) quality standards.
[9] The customer (client) bears sole responsibility for the use and implementation of the products. Any claims for damages on the part of the commissioning organization, its members or third parties are expressly excluded to the extent permitted by law.
[10] Any errors and defects in the products caused intentionally or through gross negligence by dropz AG shall be corrected by dropz AG at its own expense. This correction includes the correction of reports and statements and, if necessary, the holding of discussions. Any other claims for damages are expressly excluded.
[11] Liability for auxiliary persons within the meaning of Art. 101 of the Swiss Code of Obligations is fully excluded to the extent permitted by law.
4.2 Confidentiality and data protection
[12] dropz AG treats all company and personal data that it obtains in connection with its activities or that it generates through its activities (e.g. test reports) with absolute confidentiality. It does not pass them on to unauthorized persons or external third parties. Exceptions are permitted if an organization or an individual expressly authorizes dropz AG to do so. The naming of customer names as a general reference is also permitted.
[13] Personal data that is particularly worthy of protection (e.g. personality profiles) is handled by dropz AG with the necessary care, which at least corresponds to the provisions of the Swiss Federal Data Protection Act.
[14] If individual, personal reports on individual members of an organization are created as part of orders, dropz AG considers these individuals to be the only authorized recipients of this information, regardless of who placed or paid for the order.
[15] Reports or information within the meaning of point [14] dropz AG only provides reports or information to authorized persons. Reports or information to other persons, in particular to other members of the organization and superiors, will only be provided with the consent of the authorized person.
[16] One from point [15] is permitted if a different procedure has been agreed in a way that is recognizable to all parties involved (e.g. in the context of aptitude tests, assessments, employee surveys, etc.). If the employees concerned have been informed of the deviating procedure in advance and they do not object, it is deemed to have been accepted.
[17] The protection of the client's privacy is of the utmost importance to dropz AG. It naturally complies with the statutory provisions on data protection. The client has the possibility at any time to request information free of charge about the personal data stored about him (scope, purpose) or to request its deletion. This data will not be passed on to third parties without express permission.
4.3 Intellectual property
[18] For the fulfillment of its business purposes, dropz AG uses generally accessible technical and methodological knowledge, knowledge taken from other sources and knowledge that it has developed, refined and adapted to specific customer circumstances.
[19] If technical and methodological knowledge is taken from other sources, this is declared as a citation, or there is a corresponding agreement between dropz AG and the copyright holder.
[20] dropz AG claims the copyright to all its documents.
[21] The use of dropz AG documents, whether for commercial or non-commercial purposes, is only permitted with the express consent of dropz AG or within the framework of a license agreement.
4.4 Applicable law and place of jurisdiction
[22] Swiss law shall apply exclusively.
[23] The exclusive place of jurisdiction is the registered office of dropz AG.
4.5 Debt collection
[24] If debt collection is initiated due to non-payment of an invoice, the customer will be charged an additional fee of CHF 50.00.
